Slips – Bars, Pubs and Nightclubs

There seems to be somewhat of a stigma attached to telling people that you had a fall or a slip in a pub; the inevitable rolling of the eyes and the comments about having had one too many are almost guaranteed to follow. Yes, of course, we all have a degree of personal responsibility to ensure that we take adequate care of ourselves but that doesn’t mean that simply by having a drink or two pub and bar owners are somehow completely exempt from complying with health and safety rules and looking after us while we are on their premises. That of course not forgetting the 20% plus of UK adults who chose not to drink alcohol at all and the vast majority of the rest who drink sensibly and in moderation.

We should all be able to go to a bar, a pub or a nightclub and be protected, as far as is practical, from slip or trip injuries but sadly the number of cases that we at Russell Worth solicitors help with every year tells a different tale.

The stories we hear are all too familiar ones:-

  1. Spilt drinks or discarded food on the floor. This MUST be cleaned up quicky and properly or an accident isn’t just likely, it is all but inevitable.
  2. Allowing drinks onto dancefloors never ends well. They will get spilt; people will fall over and they will get hurt.
  3. Tripping over unseen steps in bars and clubs is an almost daily occurrence, the consequences can be horrendous if you are carrying a glass or glasses.
  4. Poor lighting. Bars and nightclubs seem to get darker and darker as the years go by as the owners try to offer us something ‘moody’ or ‘atmospheric’. All too often what they actually give us is pitch black and dangerous.
  5. Damaged or indeed non-existent handrails resulting in falls both up and down stairs. If this is coupled with low lighting, either deliberate or through lack of maintenance then accidents will happen.
  6. Slips in the bathrooms. Bathrooms need to be regularly monitored and cleaned to ensure that, as far as is reasonable, the floors are kept clean and dry.
